Arbitration & Dispute Resolution Policy – Idefix AI

    1. Introduction

At Idefix AI, we are committed to resolving disputes in a fair and efficient manner.
This Arbitration & Dispute Resolution Policy outlines the process for handling conflicts between:
    Users and Idefix AI.
Users and third-party experts engaged through the platform.

    2. Scope of This Policy

This policy applies to any disputes, claims, or controversies arising from:

The use of Idefix AI services, including AI-generated insights and expert consultations.
Payment disputes related to subscriptions, transactions, or refunds.
Disagreements between users and third-party experts engaged through the platform.
Any other legal claims related to Idefix AI operations, excluding criminal matters.

    3. Dispute Resolution Process

We encourage users to attempt to resolve disputes through the following process:

Step 1: Informal Resolution – Contact Idefix AI’s support team to seek a resolution. Most issues can be resolved without formal proceedings.
Step 2: Mediation – If the issue is not resolved informally, both parties agree to mediation. A neutral mediator will assist in finding a mutual agreement.
Step 3: Arbitration – If mediation is unsuccessful, disputes will be resolved through binding arbitration.
Step 4: Legal Action (if applicable) – If arbitration is not enforceable in your jurisdiction, disputes may proceed to legal action in the designated jurisdiction.

    4. Binding Arbitration Clause

By using Idefix AI, you agree that any dispute shall be resolved exclusively through binding arbitration, except where prohibited by law. Arbitration will be conducted under the following terms:

Arbitration will be conducted in accordance with the rules of the Dublin International Arbitration Center (DIAC) in Ireland.
The arbitrator’s decision will be final and binding, with limited rights to appeal.
Each party will bear their own legal fees, unless the arbitrator decides otherwise.
Arbitration will be conducted in English and take place in The Distillery Building, 151 Church St, Smithfield, Dublin 7, D07 WDX8, Irlande.

    5. Class Action Waiver

To the fullest extent permitted by law, all users agree that any claims must be brought on an individual basis and not as part of a class action or representative proceeding.

    6. Governing Law & Jurisdiction

This policy shall be governed by and interpreted under the laws of [Jurisdiction].
If arbitration is not legally enforceable, disputes shall be resolved in the courts of [Jurisdiction].

    For legal inquiries, contact: le***@************ot.dev

    7. Exceptions to Arbitration

This policy does not prevent users from:
    Seeking small claims court remedies.
Taking legal action for intellectual property infringement.
Addressing regulatory compliance violations directly in a competent legal forum.
